Not only is the material not copyrighted, but why would such a non-existent copyright even be recognized from a terrorist group either in Yemen or internationally? If it was created by a contractor, then {{PD-USGov}} does not apply, so the uploader needs to identify some other public domain reason, which the uploader has not done. The image in question was published on June 13, 1946 in England. According to UK copyright law, the copyright if any to this image expires at the end of 2016 (70 years from the date of publication). But according to US copyright law, since the file was published in the UK before 1978 as a publicity photo, without compliance with US formalities, it is thereby in the public domain in the United States, where the servers of Wikipedia are located (Virginia). Therefore the image in question can only be used on the English-language Wikipedia and should not be transferred to Wikimedia Commons until the end of 2016.

According to UK copyright law, the copyright to this image expires 70 years after the death of the photographer.
According to US copyright law, the copyright expires 95 years after the photograph was first published. Compliance with US copyright formalities is irrelevant unless the photograph was published in the United States within 30 days after publication in the UK or the photographer was a US citizen living in the United States, of which we have no evidence. --Stefan2 (talk) 20:45, 26 January 2015 (UTC)[reply]

In addition, works published before January 1, 1978, are governed by the 1909 Copyright Act. Under that law, if a work was published under the copyright owner’s authority without a proper notice of copyright, all copyright protection for that work was permanently lost in the United States.       • The copyright was not renewed. Every source I've seen online—including the Internet Archive, which has a lot to lose by hosting copyrighted material—lists the film as a public domain work.           • The 95-year protection is not automatic. See the relevant passage from your link: "Published in compliance with all US formalities (notice, and renewal for pre-1964 works)". All of this applies to M—except that M's copyright was not renewed when its initial 28-year protection expired. As you can read on this page:
            • "M. ©Foremco Pictures Corp. and Nassau Films, Inc. (Nero Films, author); 11May31; LP3800. [Film Superlist includes a Copyright Office Search Report on this film, documenting that the Copyright Office sought a renewal record on this film among its records and failed to find one.]"
          • There is no question that the film fell into the public domain. The only issue is whether a valid copyright to M was restored as a result of the URAA, which I'm less clear on. JimmyBlackwing (talk) 23:58, 27 January 2015 (UTC)[reply]
              • The 95-year protection is automatic for German films, unless more or less everyone involved in the creation of the film died before 1926.                 • None of that brings anything new to the table. Here are the facts: 1) the film fell at least for several decades into the US public domain, because its copyright was not renewed after the initial 28-year protection period expired; 2) its copyright may have been restored after the URAA. The Internet Archive seems certain that its copyright was not restored, but it's possible that a mistake has been made. It depends on whether the film was in the German public domain at the time of the URAA, which is information that I don't have.                   • The Internet Archive often provides incorrect information. The only thing you need to know is that the film was first published after 1920. By knowing this, you know that the copyright was restored and that the film is subject to the full copyright term of 95 years from publication, as explained at c:COM:HIRTLE. It is not my fault that you can't read the page properly. Also, on the question on whether the film was in the German public domain or not, you will have to consider that copyright expires in Germany 70 years after the death of certain people.
