The result of the discussion was: delete as blatant copyvio. If it is re-uploaded with a sensible name and proper fair use tag, then it will probably stick. — RHaworth (talk · contribs) 11:25, 27 August 2013 (UTC)[reply]

- File:Bernard S Baker.jpg (delete | talk | history | logs).
- Used here in 2004 so own work claim is dubious. Stefan2 (talk) 17:13, 27 August 2013 (UTC)[reply]
I don't know how to respond to this. I am Bernard Baker'[s son. My name is William Baker. My family owns this photo. Why are you questioning its owner? Who are you, anyway? — Preceding unsigned comment added by Bakercg (talk • contribs) 18:07, 27 August 2013 (UTC)[reply]
- Where does the photo come from? Who is the photographer? Is this some kind of "official" photo? I see it on a lot of pages about the person's scientific discoveries. --Stefan2 (talk) 18:16, 27 August 2013 (UTC)[reply]
- User owns a copy of the photo, not the actual photo itself. Copyright belongs to the photography company that produced it. Should be deleted as copyright violation without release. Caffeyw (talk) 11:51, 28 August 2013 (UTC)[reply]
>This photo was commissioned by my family. We purchased all rights from the photographer. You see it distributed broadly because it was the photo used to send to the press when my father died in 2004. Do I need to get a release form from the original photographer? We bought and paid for it more than 15 years ago. I'm not even sure I remember who the original photographer is or if he is still alive.Bakercg (talk) 15:24, 29 August 2013 (UTC)[reply]
- According to US Copyright Law, §201, section b)
- "Works Made for Hire.--In the case of a work made for hire, the employer or other person for whom the work was prepared is considered the author for purposes of this title, and, unless the parties have expressly agreed otherwise in a written instrument signed by them, owns all of the rights comprised in the copyright."
- As this was a work for hire the copyright does NOT belong to the photographer. (That the copyright ALWAYS belongs to the person who physically took the picture is a common misconception around here) If more permission is required then the OTRS system is the route to go. Not sure if en:WP has this... image may need to be uploaded to Commons. Bakercg, unfortunately you may need to jump through a few hoops, but you should be able to keep this image. – JBarta (talk) 21:15, 3 September 2013 (UTC)[reply]
