File:Argobba Woman.jpg (delete | talk | history | links | logs) – uploaded by EthiopianHabesha (notify | contribs | uploads | upload log).

Image is marked as public domain but there is no proof. Per the terms of use on the source site, the photos are a mix of copyrighted on non-copyrighted works and the licensing is thus on a per photo basis. The page with this particular photo states that photo source is anonymous with no further information. There is no indication that the photo is public domain as claimed by the uploader. Whpq (talk) 14:46, 19 December 2016 (UTC)[reply]

Whpq, according to the term of use photos are a mix of non-copyrighted and copyrighted works and the licensing is thus on a per photo basis, and based on these examples [1][2][3] photos that are copyrighted have "© Copyrighted Used with permission" indicated in the source listing below photos while the picture I uploaded [4] do not have that copyright notice. — EthiopianHabesha (talk) 16:59, 19 December 2016 (UTC)[reply]
@EthiopianHabesha: "Used with permission" is an invalid release statement on Wikipedia as it isn't specific enough. In order to qualify for inclusion here the photo must be under an explicit free license which allows anyone to use or modify the photo, at any time, and for any reason (including commercial use). Just because something doesn't say "copyrighted" doesn't mean it isn't. Quite the opposite actually. Every photo is automatically copyrighted upon creation. Period. No exceptions. Without an explicit release statement that says it is under a free license you can't assume you can use it here. And you certainly can't assume it is in the public domain. --Majora (talk) 23:13, 19 December 2016 (UTC)[reply]

Reason why I chose "This file is from a free published source" when uploading the image is because the photos that are non free are labeled as "© Copyrighted Used with permission" and also because I did not find any photos in the site clearly stating free [5][6] then I took it the photo is free to use based on term of use "photos are a mix of non-copyrighted and copyrighted". Anyways, since there is no clear indication the photo being copyrighted like stated on the other images [7][8][9] can we put it under the category "This is a copyrighted, non-free work, but I believe it is Fair Use."? — EthiopianHabesha (talk) 10:21, 20 December 2016 (UTC)[reply]

I don't think it would meet all the non-free content criteria, and in particular point 1 on replaceability. -- Whpq (talk) 12:10, 20 December 2016 (UTC)[reply]
Whpq would be correct EthiopianHabesha In its current form it would not qualify for fair use as it would fail the first criterion. Since it is used on Abyssinian people there is nothing special about the image and anyone could take a photo of those people and upload it under a free use. Therefore, it is replaceable by our definition of the word. Sorry. --Majora (talk) 22:02, 20 December 2016 (UTC)[reply]

In my opinion, I still think photo is free to use. Otherwise, we are going to have to assume all pictures in the site is copyrighted (which would be contrary to what is stated under terms of use) and if so what is the point of labelling some pictures "copyrighted" while not on the others, and at the same time why state in the terms of use: Photos are Non-free and free and their copyright status is determined by the Copyright notices indicated below each photos. — EthiopianHabesha (talk) 09:41, 21 December 2016 (UTC)[reply]

Metadata mentions Getty Images and the Hutton Archive, so the uploader's claim to be the copyright holder is doubtful. John of Reading (talk) 17:26, 19 December 2016 (UTC)[reply]

  • Speedy delete as a copyright violation. The EXIF data makes it clear that this is a copyrighted photo with credit to Michael Ward for Getty Images. The claim of being the copyright holder is no credible. -- Whpq (talk) 19:07, 19 December 2016 (UTC)[reply]
